Terms of Use

These terms are an agreement between you and Niels Marinus Rens van Brussel ("we", "us"), covering your use of the ZIPPER app for iOS ("the App"). By creating an account or using the App, you agree to them. If you do not agree, do not use the App.

ZIPPER is intended for adults aged 18 and over. Do not use ZIPPER if you are under the legal drinking age where you are.

1. What ZIPPER is

ZIPPER is a scored party game for 3 to 8 people sharing one phone. The App prompts; the people at the table decide what they do with it. Nothing in the App requires you to drink alcohol. A card asks a player to take a number of "zips", and what is in the glass is entirely up to you. Many cards offer an action instead, both routes score the same, and every card can be skipped.

Please drink responsibly, know your limits, and never drive after drinking.

2. Your account

You can play ZIPPER without an account. If you create one, you are responsible for what happens under it and for keeping your sign-in details to yourself. You must give accurate information, and you may not create an account on behalf of someone else or impersonate anybody.

You can delete your account at any time from Settings → Delete account inside the App. Deleting removes your username, profile picture, biography, friend connections and every photo you have shared. It cannot be undone.

3. Content you create

If you create an account you can add a username, a profile picture and a short biography, and you can share photos taken in the App with people you have accepted as friends. We call all of this "your content". You keep ownership of it. You grant us only the permission we need to store it and show it to the people you have chosen to share it with.

You are responsible for your content, and you confirm you have the right to share it. If a photograph has other people in it, you must have their agreement before you share it.

4. Zero tolerance for objectionable content and abuse

There is no tolerance for objectionable content or abusive behaviour on ZIPPER. You may not upload, share or send anything that:

• is sexually explicit, or depicts nudity of any kind;
• harasses, bullies, threatens, defames or intimidates another person;
• attacks or demeans people on the basis of race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation or age;
• depicts, promotes or glorifies violence, self-harm, eating disorders or the use of illegal drugs;
• shows or involves anybody under 18;
• is illegal, or encourages anybody to do something illegal;
• impersonates another person, or misrepresents who you are;
• shares another person's private information without their agreement;
• is spam, advertising, or an attempt to sell something.

5. Reporting, blocking, and our 24 hour commitment

Every profile in ZIPPER carries a Report control and a Block control, in the menu at the top right of that person's profile. Blocking takes effect immediately: a blocked person cannot find you in search, cannot send you a friend request, and any existing friendship between you is removed.

We review every report and act on it within 24 hours. Where a report is upheld we remove the offending content and eject the user who provided it, which for a serious or repeated breach means permanently terminating their account. We may remove content or suspend an account while we are still looking into a report.

6. Subscriptions and payment

Some parts of ZIPPER require a paid subscription. Subscriptions are billed through your Apple ID, renew automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled at any time in your Apple ID account settings. Your own photos, your game history and your friends stay available to you whether or not you are subscribed.

7. What you may not do with the App

• Reverse engineer, decompile or attempt to extract the source code.
• Use the App to break the law, or to help anybody else break it.
• Interfere with the App's operation, or try to reach accounts, data or systems that are not yours.
• Use automated means to access, scrape or copy the App or its content.

8. Ending this agreement

You may stop using the App at any time and delete your account from inside it. We may suspend or terminate your account if you break these terms, and we will terminate it where you have posted objectionable content or behaved abusively towards another person.

9. Disclaimer and liability

The App is provided "as is". We do not warrant that it will be uninterrupted or error free. You are responsible for your own safety and for your own decisions about alcohol. To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the App, and our total liability is limited to the amount you have paid us in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms. If a change is significant we will say so in the App. Continuing to use ZIPPER after a change means you accept the updated terms. The date at the top of this page always shows when it last changed.

11. Governing law

These terms are governed by the law of the Netherlands, and the courts of the Netherlands have jurisdiction. If you are a consumer, this does not remove protections you have under the law of the country you live in.
